Privacy Policy

  1. General
    1. hiMoment GmbH is an Austrian limited liability company, registered in the Austrian commercial register under FN 482218 w, having its corporate seat in Vienna, Austria (hereinafter referred to as ‘hiMoment‘). hiMoment offers a digital happiness guide which shall help you to focus on the good things in life, available on the website www.himoment.com and through the hiMoment-app for Android and iOs (hereinafter referred to as ‘Services‘).
    2. The content and information you upload, save or create within the Services is basically not visible to the public, unless you explicitly decide to share or distribute it.
    3. hiMoment respects the privacy of its users. The protection of your personal data is of great importance to us and we will use and process such data only in compliance with applicable data protection laws and regulations. To inform you about the personal data we collect, on how and for which purpose this data will be used and processed and about your options with regard to the update or deletion of your personal data collected by us, we developed this Privacy Policy (hereinafter referred to as ‘Privacy Policy’).
    4. By accessing and/or using the Services, you accept this Privacy Policy and consent to the use and processing of your personal data as described herein. Please read this Privacy Policy carefully before accessing and/or using the Services.
    5. hiMoment reserves the right to fully or partially modify this Privacy Policy at any time and – subject to legal requirements – in its sole discretion. You are responsible to inform yourself periodically about any modifications of this Privacy Policy. The current version of the Privacy Policy will always be available on our website as well as in our apps. Registered users of our Services will be informed about any such modifications by a notice through the Services or via e-mail. If you continue to access or use our Services, you accept the modified Privacy Policy. If required by law, we will seek your consent to the modified Privacy Policy.
    6. hiMoment implements reasonable measures to protect your personal data from unauthorised access, destruction and modification.
    7. We will not use, process or share your personal data with third parties except (i) to the extent such sharing is permitted by applicable data protection laws, (ii) if we believe that it is reasonably necessary to comply with any applicable law, legal process or enforceable request from any competent governmental agency or (iii) as otherwise described in this Privacy Policy.
  2. Use of non-personally identifiable information
    1. We may use, process and share non-personally identifiable information we collect from you while using the Services with third parties. This particularly includes the using, processing and sharing of aggregated, anonymised data.
    2. hiMoment, inter alia, intends to add to the existing body of research on the topic of positive psychology and work with scientists from various fields. For this purpose, hiMoment will share aggregated, anonymised data for respective analysis.
  3. Contributing to your happiness and adding to science
    1. In order to register with hiMoment and use the Services, you will either have to create an account with hiMoment or log in via your Facebook account. Upon the opening of an account with hiMoment, we ask you to provide certain personal data, which may include your first name, last name, e-mail address, gender, date of birth, phone number and postal address. If you decide to register by connecting to your Facebook account, you will need to provide your Facebook login-data. If you register with hiMoment via your Facebook account, we may, subject to the privacy settings you set in your Facebook account, obtain information and personal data from this account (such as profile picture, friends list). If you do not provide the requested data, you may not be able to access the Services (in whole or in parts).
    2. We further collect and process data you provide when using the Services such as information about the themes and topics of your moments, including photos, and how you value each of them. Your photos will be stored via Amazon Web Services.
    3. We process your personal data as specified above in order to manage your account, provide customer support, send you legal notices and to provide and constantly improve the Services. We may also collect your personal data in order to contribute to scientific studies and research. However, before any further processing of data for scientific purposes, the data will be aggregated and anonymised.
    4. The processing of your personal data as described under this section 3 is based on your consent (Article 6 paragraph 1 lit a Regulation (EU) 2016/679, General Data Protection Regulation (hereinafter referred to as ‘GDPR’)) or, if applicable, on our obligation to fulfil contractual agreements (Article 6 paragraph 1 lit b GDPR) or our legitimate interest (Article 6 paragraph 1 lit f GDPR) in operating the Services, providing customer support and contributing to science.
    5. The personal data processed according to this section 3 will be stored as long as you hold an account with hiMoment. Beyond that, we will store your data as long as and to the extent to which we are obliged to do so by legal provisions, e.g. for a period of seven years if respective tax and/or accounting legislation applies.
  4. Commercial Information
    1. We use your personal data for communication with you. If you register with hiMoment and provide your e-mail address, you accept that hiMoment informs you via e-mail about new features, asks for your feedback or just lets you know about the latest news regarding hiMoment.
    2. The processing of your data in connection with commercial information is based on your consent (Art 6 para 1 lit a GDPR).
    3. You may unsubscribe from receiving commercial messages from us by using the respective link at the bottom of our e-mails containing such commercial messages. We will subsequently delete your data in connection with the provision of commercial information.
  5. Contacting us
    1. We collect personal data you provide when contacting us (such as your name, e-mail address, postal address or phone number) and will use such data for the purpose of processing your request. The personal data collected in connection with such requests will be stored for the event that follow-up-communication occurs for a period of up to twelve months.
  6. Cookies
    1. We use cookies (hereinafter referred to as ‘Cookies’) on www.himoment.com and in our iOs and Android app. Cookies are small text files placed on your device (e.g. mobile device, computer) and stored in your browser. The use of Cookies helps us to improve the security and functionality of the Services, to personalise our Services and make them more user-friendly.
    2. If you wish to refuse the use of Cookies, you may do so by selecting the appropriate settings in your browser. However please note that if you deactivate Cookies, certain features of the Services may not work properly or will not be accessible to you.
  7. Analysis tools
    1. Google Analytics
      1. We use Google Analytics, a web analytics service provided by Google Inc., 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA (hereinafter referred to as ‘Google‘).
      2. Google Analytics uses Cookies to analyse traffic and usage of the Services. The information received by the use of the Cookies is transferred to and stored by Google on a server located in the United States (based on EU-US Privacy Shield). Google will evaluate the information received for the purpose of providing us with analyses and reports, as well as other services that help us to understand how people are using our Services.
      3. The information collected by Google Analytics’ Cookies includes your IP-address. However, as hiMoment activated IP-anonymization, Google shall truncate and thereby anonymise your IP-address. Thus, your IP-address shall be anonymised before being stored on the above-stated server located in the United States.
      4. The processing of data via Google Analytics is based on your consent (Art 6 para 1 lit a GDPR) or, if applicable, on our legitimate interest (Art 6 para 1 lit f GDPR) in operating and improving our Services.
      5. As already stated above, if you wish to refuse the use of Cookies, you may do so by selecting the appropriate settings in your browser. Further, to making these settings, in order to prevent that your data is collected and used by Google, you may also download and install the Google Analytics opt-out browser add-on available under https://tools.google.com/dlpage/gaoptout?hl=en.
    2. Facebook Pixel and Twitter Conversion Tracking
      1. We use Facebook Pixel, an analytics tool provided by Facebook Ireland Ltd, 4 Grand Canal Square, Grand Canal Harbour, D2 Dublin, Ireland (hereinafter referred to as ‘Facebook‘).
      2. We further use Twitter Conversion Tracking, an analytics tool provided by Twitter International Company, Cumberland Place, Fenian Street Dublin 2, D02 AX07 Ireland (hereinafter referred to as ‘Twitter‘).
      3. The information collected and processed by Facebook Pixel and Twitter Conversion Tracking includes personal data you provide via your Facebook-Account, respectively via your Twitter-Account. We use Facebook Pixel and Twitter Conversion Tracking in order to measure conversion rates and to target visitors of our website with advertisements for our Services in their Facebook/Twitter-Account.
      4. The processing of your personal data via Facebook Pixel and Twitter Conversion Tracking is based on your consent (Art 6 para 1 lit a GDPR) or, if applicable, on our legitimate interest (Art 6 para 1 lit f GDPR) in efficiently promoting the Services.
  8. Push Notification Services
    1. We use OneSignal, a push notification service provided by OneSignal Inc, 2194 Esperanca Avenue, Santa Clara, CA 95054, United States, (hereinafter referred to as ‘OneSignal‘) in order to send, manage, optimise and customise push notifications to our users. The personal data collected by OneSignal includes your IP-address and is transferred to and process in the United States. For further information please refer to the privacy policy of OneSignal available under https://onesignal.com/privacy_policy.
    2. The processing of your personal data via OneSignal is based on your consent (Art 6 para 1 lit a GDPR).
    3. You may opt out of receiving push notifications by selecting the appropriate settings on your device.
  9. Third-party services
    1. Please note that the Services may contain links to third-party apps, websites or services that are not operated or controlled by hiMoment and such third-party apps, websites or services may link to our website or our apps. hiMoment makes no representation or warranties with regard to and is not responsible for the content, functionality, legality, security, accuracy or other aspects of such third-party apps, websites or services. Note that for accessing and/or using third-party services their own privacy policy may apply.
  10. Your rights regarding the process of your personal data
    1. You may at any time withdraw your consent to the processing of your personal data. Upon such notice of withdrawal, we will cease to process your personal data and delete the data collected, except where processing your personal data is lawful even without your consent, like for example in case we have any legal obligation or legitimate interest. Please note, that such a withdrawal does not affect the lawfulness of processing your data based on your consent before the withdrawal.
    2. You have the right to request from hiMoment access to, rectification or erasure of your personal data or restriction of the processing of your personal data or to object to such processing; you also have the right to data portability. Please send such requests to via e-mail to hi@himoment.com.
    3. If you consider that the processing of your personal data infringes applicable data protection law, you may lodge a complaint with the competent supervisory authority.
